1. Agreement to these terms

These Terms & Conditions (“Terms”) govern access to hominiti.com and purchases from HOMINITI. The store is operated by REXOH LLC, a Wyoming limited liability company. By using the website, creating an account, or submitting an order, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the store.

Nothing in these Terms limits a consumer right that cannot lawfully be waived.

2. Eligibility and United States sales

You must be at least 18 years old or the age of legal majority where you live and able to enter a binding contract to place an order. The store is intended for a general adult audience. HOMINITI currently accepts orders for delivery only within the United States.

3. Store information and incorporated policies

If a product page contains a specific written term that conflicts with a general statement in these Terms, the specific product-page term controls for that product, except where prohibited by law.

4. Products and availability

We work to present product descriptions, specifications, colors, dimensions, availability, and images accurately. Screen settings, photography, manufacturing variations, or supplier information may cause minor differences. Product images are illustrative unless the page expressly states otherwise.

Products and quantities may be limited, changed, or discontinued. Placing an item in a cart does not reserve it. We may limit quantities per customer, household, payment method, or address when reasonably necessary to prevent fraud, resale abuse, or inventory errors.

5. Prices, taxes, and errors

Prices are displayed in U.S. dollars unless stated otherwise. Applicable sales tax is calculated or displayed during checkout when required. Standard shipping is currently free for eligible United States orders as described in our Shipping Policy.

We may correct typographical, pricing, inventory, or product-information errors. If an error affects an order after payment authorization, we will contact you and provide an appropriate choice, which may include confirming the corrected terms or canceling the affected item for a full refund.

6. Orders and contract formation

Your order is an offer to purchase. An automated order-confirmation email acknowledges receipt but does not by itself mean that the order has been accepted. We accept an order when we confirm fulfillment or ship the product, subject to applicable law.

We may reject or cancel an order before shipment for legitimate reasons, including product unavailability, an obvious error, inability to verify payment or delivery information, suspected fraud, prohibited activity, or an address outside the supported delivery area. If we cancel a paid order, we will issue a refund to the original payment method.

7. Payment

You agree to provide current, complete, and accurate billing and payment information and represent that you are authorized to use the selected payment method. When online payments are enabled, payment information may be processed by an independent payment provider under its own terms and privacy policy. We may use payment authorization, address verification, and fraud-prevention services.

A payment authorization may temporarily reduce available funds before a final charge or release is posted by your financial institution. HOMINITI is not responsible for a bank’s separate processing time or fees.

8. Order changes and cancellation requests

Contact info@hominiti.com promptly if you need to request an address correction or order cancellation. We will try to assist, but cannot guarantee a change or cancellation after fulfillment has begun. This does not affect a right to cancel that applicable law independently provides.

9. Shipping and delivery

Shipping is governed by our Shipping Policy. The current estimated delivery window is 7–10 business days after payment confirmation for eligible United States orders. Delivery estimates are not guarantees, but we must have a reasonable basis for any shipping representation we make.

If we learn that we cannot ship within the promised time, we will provide notice and the legally required opportunity to consent to the delay or cancel for a prompt refund. Title and risk of loss transfer only as provided by applicable law and the carrier arrangement; nothing here removes rights relating to products not received.

10. Returns and refunds

Eligible orders are covered by our Returns & Refunds Policy, including the 30-day return-request period and free authorized return shipping for eligible United States orders.

Nothing in the return policy limits remedies that cannot lawfully be excluded for damaged, defective, or materially misdescribed products.

11. Product warranties

A product may include a written manufacturer or seller warranty when expressly stated on its product page or accompanying documentation. Any such written warranty is separate from these general Terms and will be made available as required by law. Product descriptions or factual promises may create rights under applicable law.

Except for an express written warranty and to the maximum extent permitted by law, no additional voluntary warranty is made by HOMINITI. We do not exclude implied warranties or consumer remedies that applicable law does not allow us to exclude.

12. Accounts and security

You are responsible for providing accurate account information, safeguarding your password, and restricting access to your account and devices. Notify us promptly at info@hominiti.com if you suspect unauthorized activity. We may suspend or restrict an account when reasonably necessary to protect customers, the store, or legal rights.

13. Acceptable use

You may not:

• use the website for unlawful, fraudulent, or abusive purposes;
• interfere with security, availability, checkout, or another user’s access;
• introduce malicious code, scrape the site in a manner that disrupts service, or attempt unauthorized access;
• misrepresent identity, payment authority, delivery information, or return eligibility;
• copy, reproduce, or commercially exploit site content without permission except as allowed by law; or
• use the website to infringe intellectual-property, privacy, or other rights.

14. Reviews and submitted content

If you submit a review, photograph, or other content, you represent that you have the right to submit it and that it is accurate, lawful, and does not violate another person’s rights. You grant REXOH LLC a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and adapt that content for operating and promoting HOMINITI, subject to our Privacy Policy. We may moderate or remove content that violates these Terms.

15. Intellectual property

The HOMINITI name, site design, text, graphics, logos, and original website content are owned by or licensed to REXOH LLC and are protected by applicable intellectual-property laws. Product names and third-party marks belong to their respective owners. No license is granted except the limited right to use the website for personal, lawful shopping.

16. Third-party services and links

The website may rely on or link to third-party services such as payment processors, carriers, email providers, fonts, or social and profile services. A third party’s own terms and privacy policy govern its independent service. A link does not imply endorsement, and we are not responsible for third-party content or practices outside our reasonable control.

17. Website availability and disclaimers

We aim to keep the site accurate, secure, and available, but maintenance, updates, network failures, and events outside our reasonable control may interrupt access. To the maximum extent permitted by law, the website and general site features are provided on an “as available” basis. This paragraph does not disclaim an express product promise, a written warranty, or any non-waivable consumer right.

18. Limitation of liability

To the maximum extent permitted by applicable law, REXOH LLC will not be liable for indirect, incidental, special, exemplary, or consequential damages arising solely from use of, or inability to use, the website. For claims relating to a purchased product or order, any monetary limitation will not be lower than the amount paid for the affected product.

These limitations do not apply to fraud, willful misconduct, gross negligence, personal injury caused by negligence, violation of a non-waivable statutory duty, or any liability that applicable law does not permit us to limit.

19. Events outside reasonable control

We are not responsible for delay caused by events outside our reasonable control, such as severe weather, carrier disruption, labor disputes, natural disaster, government action, cyberattack, utility failure, or supply interruption. We will still comply with applicable duties concerning delay notices, cancellation choices, and refunds.

20. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming and applicable federal law, without regard to conflict-of-law principles. Subject to any non-waivable right to bring a claim elsewhere, disputes may be brought in the state or federal courts serving Natrona County, Wyoming. Before filing a claim, you are encouraged to contact us so that we can attempt a good-faith resolution.

These Terms do not require arbitration and do not waive any right to a jury trial or participation in a class action where such rights otherwise exist.

21. Changes to these Terms

We may update these Terms for future use of the website or future orders. Revised Terms will be posted with a new “Last updated” date. The Terms in effect when an order is submitted will generally govern that order, unless a change is required by law or you agree to a change.

22. General provisions

If a provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent, but REXOH LLC may assign them in connection with a business transfer, subject to applicable law. Electronic communications and records may satisfy writing requirements where legally permitted.
